Please read these rules before you complete an order. The text explains accepted use, prohibited content, abuse, and suspension of the service.
Important: This agreement applies to the services offered by MUVCloud. It sets the rules for data-center services and software use between individuals or legal entities and Revive IT Solutions LLC. Read the terms of service in full before you order any product or service on our website. The terms of service contain the rules you must follow. If you do not accept this agreement, or any part of it, cancel the order and do not order any product or service.
Article 1. Subject of This Addendum and the Parties
1.1: This agreement is an integral part of the General Service Agreement and is added to the General Service Agreement.
1.2: The parties to this agreement are those named in the General Service Agreement.
1.3: The subject of this agreement is the rules the Customer follows while using the services MUVCloud provides.
Article 2. Opening An Account
2.1: When the Customer orders a service by registering online, the first payment is processed after the required checks and only if no fraud is found. Those checks include whether the customer details are accurate. Identity information may be requested from a suspicious user so that identity can be confirmed by the state. If the Customer cannot verify that information, the service is not provided.
2.2: Information about how to use the services is sent to the email address the Customer specifies. Keeping a working and accurate email address is the Customer's responsibility.
2.3: By this agreement, the Customer is deemed to warrant that the information given when the account was created is accurate.
Article 3. Rules for Virtual and Dedicated Server Services
3.1: Removing rented hardware from the data center, adding parts from outside, or requesting any part is strictly prohibited.
3.2: On all cloud and virtual server services, MUVCloud may stop the service if an activity could interrupt continuity of the system or prevent other customers from receiving service. The Customer agrees, by this agreement, that MUVCloud is not liable for financial or non-financial loss that may result.
3.3: If a server is seized for legal reasons arising from a criminal matter, the Customer agrees, by this agreement, to pay MUVCloud's loss in cash and in a single payment within 5 business days.
3.4: The Customer is not responsible for faults in rented hardware that belongs to MUVCloud. The Customer also agrees, by this agreement, not to hold MUVCloud liable for loss caused by hardware faults. MUVCloud replaces parts of rented hardware at no charge, or, if the required part or server is not in stock, with an equivalent part or server.
3.5: If MUVCloud is only an intermediary for the service provided to the Customer, MUVCloud is not responsible for hardware faults. The Customer agrees, by this agreement, not to hold MUVCloud liable for financial or non-financial loss that may result.
3.6: Unless stated otherwise, server services located in Turkey are provided on a 1 Gbps port with no traffic cap. They are provided that way so that short bursts of high use, and attacks aimed at the customer, do not take the service down. Continuous high use of the connection (including streaming, file sharing, and video on demand) is not permitted on those services. The fair-use threshold for one dedicated server is 10 TB per month. If use goes above that threshold, MUVCloud gives notice and asks that a dedicated connection be ordered. If that request is not accepted, the port is limited to 10 Mbps until the end of the month. For virtual server services the fair-use threshold is 3 TB per month. Use above that threshold follows the same dedicated-connection process used for dedicated servers.
Article 4. Restrictions
4.1: During an attack or other Internet activity large enough to affect backbone or local Internet traffic, MUVCloud's priority is that current customers' services are not interrupted. MUVCloud may therefore cut Internet access for the Customer's IP addresses, servers, or network equipment. The Customer agrees, by this agreement, not to hold MUVCloud liable for any resulting loss.
4.2: If attacks or similar Internet activity large enough to affect backbone or local Internet traffic keep recurring, MUVCloud may cancel the service the Customer receives.
4.3: Because of harmful activity by the Customer, MUVCloud may restrict the Customer's service (including closing a port, blocking IP access, and similar measures). The Customer agrees, by this agreement, not to hold MUVCloud liable for any resulting loss.
4.4: By accepting service from MUVCloud, the Customer accepts that ping, tracert, and finger services will not be enabled.
Article 5. Prohibited Activities
5.1: MUVCloud may restrict the service of a customer who sends spam. Customers who take an SMTP relay service may not send spam. A Customer who runs an SMTP server, whether or not that Customer also takes an SMTP relay service from MUVCloud, may not run the SMTP relay on that server without protection or open to use by third parties in a way that makes spam easier.
5.2: The service may be restricted or terminated if the Customer engages in conduct that infringes another person or organization's copyright, registered trademarks, service marks, trade secrets, or patent rights, including software piracy, or conduct that would be an offense for a customer in Turkey under the Law on Intellectual and Artistic Works, the Trademark Law, the Turkish Commercial Code, or the Law on the Protection of Patent Rights, or conduct that invades personal rights or privacy. For a customer in Turkey, that conduct is an offense against intellectual and artistic works.
5.3: If MUVCloud's services are used to carry out conduct contrary to generally accepted public morals and customs, or to assist that conduct, the service may be restricted or terminated because of publications or conduct contrary to public morals and customs.
5.4: The service may be restricted or terminated if it is used to attempt unauthorized or unlawful access to computers, user accounts, or networks that belong to others (conduct described as hacking), or for other activity that provides unlawful or unauthorized access to systems (including port scans, stealth scans, and similar activity), or for phishing (fraud that uses fake websites or messages to obtain other people's personal information).
5.5: The service may be restricted or terminated for sending Internet viruses, worms, or Trojan horses, or for activity such as pinging, flooding, mailbombing, or denial of service that disrupts other users' use of the MUVCloud network or of another network, system, service, or device connected to it.
5.6: The Customer agrees to protect and keep confidential every piece of confidential information learned about MUVCloud. Confidential information includes MUVCloud's products and any information MUVCloud marks as confidential; any information about any business MUVCloud carries on (including its discovery, invention, research, development, manufacture, and sale), its processes, or its general commercial activity (including sales costs, profit, pricing methods, and organization and staff lists); and, unless this article says otherwise, all information or data obtained by access to MUVCloud's information sources and systems (including computers, communications networks, and every means of communication). The list is not exhaustive.
5.7: Even if an activity is not listed here, the service may be restricted or terminated if the activity is contrary to the laws of the Republic of Turkey in force, or is a criminal offense under those laws, and the Customer does not refrain from it. This clause states the rules that apply to customers in Turkey.
Limits on Hosting Servers Under Our Control (Web Hosting and Reseller Services)
5.8: Illegal publication: Hosting copyrighted works, commercial audio, video, or music files, or any other material prohibited by the laws of the Republic of Turkey is strictly forbidden. The account will be suspended if this is found. This clause states the rules that apply to customers in Turkey.
5.9: Material contrary to public morals: Hosting pornography, erotic images, videos, and similar content is strictly forbidden. The account will be suspended if this is found.
5.10: Games and animation: Hosting Jumpling, MUDs, Egg Drop, interactive games, and SWF files on the FTP server is strictly forbidden. The account will be suspended if this is found.
5.11: Offensive material: Hosting discriminatory or hostile content aimed at any religion, language, race, gender, or similar social group is strictly forbidden. The account will be suspended if this is found.
5.12: File storage: Using a hosting or reseller package as a file store or file-sharing service, or hosting program files such as exe or bat on the servers, is strictly forbidden. The account will be suspended if this is found.
5.13: Hack and hacking: Hosting or using applications, programs, or attack tools needed for hacking is strictly forbidden. The account will be suspended if this is found.
5.14: Other material: Using proxy scripts, anonymizers, and IP scanners, and using mail bombers and spam scripts, is strictly forbidden, as stated in article 5.5. The account will be suspended if this is found. The customer is fully responsible for financial loss that may result from spam.
Article 6. Scope of Technical Support
6.1: Unless a support service has been purchased and a service level agreement has been added to the contract, MUVCloud does not check whether a service is up or down. When there is a problem, the customer must report it by sending a support ticket from the client area. Technical support requested orally or in writing by phone, email, or any other channel will not be answered.
6.2: Support tickets are answered in the order received. The customer should state how urgent the issue is when sending the ticket. Unless a support service has been purchased and a service level agreement has been added to the contract, the response-time commitment for a technical support ticket is 8 hours at the latest.
6.3: If a support ticket includes server login details without a full description of the problem, the ticket will be closed without a resolution. Describing the problem on the ticket in a detailed and understandable way is in the customer's interest, so that we can help.
6.4: Unless a support service has been purchased and a service level agreement has been added to the contract, a support ticket that takes more than 4 hours to resolve may be charged according to the nature of the work. The charge is stated to the customer on the ticket and is invoiced if the customer accepts it.
6.5: Unless a support service has been purchased and a service level agreement has been added to the contract, the customer is deemed to have authorized our technical staff, by sending a support ticket, to carry out software tasks the customer could not do or fix. MUVCloud and the support staff who do the work are not liable for an error that results from that work.
6.6: If a support ticket the customer sends or replies to threatens, insults, demeans, or offends MUVCloud or any member of its staff, and the staff member reports it to senior managers of Revive IT Solutions LLC, the service is cancelled after the ticket is reviewed. During the time allowed to move the data, the customer may not send another support ticket or contact the company.
6.7: For security, and so that we can give customers a better service, every support ticket is recorded. A ticket is not deleted from the customer's panel and is archived. The customer may not ask for a ticket to be deleted from the system, and may not publish a picture or copy of an answered ticket in a public place. The service will be cancelled if this rule is broken.
6.8: The customer may not open a support ticket for a product or service that belongs to someone else and is not added to the customer account. Such a ticket is not answered. For security, the ticket must be sent from the panel of the customer on whose account the product or service is registered.
Article 7. Cancellation and Refunds
7.1: The Customer may tell us about a service to be cancelled only by sending a cancellation request through the client portal. Cancellation requests made by email, phone, or any other channel are not accepted.
7.2: There is no refund for licenses, software, and similar products or services for which MUVCloud is an intermediary and which MUVCloud does not produce or own. MUVCloud is an intermediary in providing those services. The Customer may cancel a license or software service only if the due date has not passed.
7.3: If MUVCloud is not at fault, products and services offered by MUVCloud are not refunded for any reason.
7.4: If the Customer cancels a service by mistake, the Customer must send a support ticket from the client portal and ask for the error to be corrected so that the cancellation can be withdrawn. A request to withdraw a cancellation is not made orally or in writing by phone, email, or any other channel. MUVCloud is not liable for data loss if the Customer does not report, by a support ticket, that a cancellation should be withdrawn.
7.5: MUVCloud may refuse to provide service because of a legal, financial, or non-financial dispute with the Customer. In that case the customer is told by email or support ticket 72 hours in advance, and the service is stopped after 72 hours.
7.6: Orders placed, invoices that were paid or cancelled, and services that were cancelled are not deleted from the client panel and are kept for one year, so that they can be used if a legal issue arises later.
Article 8. Changes
MUVCloud may change the articles of this agreement to protect the rights of current customers and to reflect new legislation and technical developments. Changes to the agreement are notified to Customers by email.
Article 9. Courts and Enforcement Offices
The courts and enforcement offices on the Anatolian side of Istanbul have jurisdiction over every dispute arising from the performance of this agreement.
